By placing a bid on an auction item, the bidder acknowledges that he/she has read and understood the following terms and conditions, and is in full agreement with such terms and conditions.

The following terminology applies to these Terms and Conditions. “Bidder,” “you,” or “your” shall refer to you. “Company,” “Rhino Bargain,” “our,” or “we” shall refer to Rhino Bargain. “Seller” or “consignor” shall refer to the party who owns the Lot and is placing the Lot up for auction. “Lot” or “Lots” shall refer to an item or set of items for sale in an auction.

The language in all parts of these Terms and Conditions shall in all cases be construed as a whole according to its fair meaning and not strictly for nor against any party. The neuter gender includes the masculine and feminine. It is mutually agreed that in the event any term, covenant, or condition herein contained is held to be invalid or void by any court of competent jurisdiction, the invalidity of any such term, covenant, or condition shall in no way affect any other term, covenant, or condition herein contained. Captions and paragraph headings used herein are for convenience only and are not a part of these Terms and Conditions and shall not be deemed to limit or alter any provisions hereof and shall not be deemed relevant in construing these Terms and Conditions.

At the time of registration, we collect information about you to verify who you are before you can bid. All bidders must be of legal age to bid. Rhino Bargain reserves the right to suspend the account of a bidder and/or cancel any bid for any reason.

There is no cost to register for an auction. When an auction closes, if you are the winner, you must attend during the allotted Pick up time frame where you may pay cash only. All other payment methods can only be done online (Visa, Mastercard or Debit). If you do not pick up during the allotted time, your items will be deemed abandoned and relisted for a new auction. Your bidding privilege might also be revoked.

During an auction you can check the status of your bids at anytime. Note that no bids can be withdrawn after the auction for any reason. As stated in our Refund Policy, All items are sold as is, where is, with all faults with no guarantees that any item is fit for a particular use. We strongly recommend attending the previews if available on any and all auctions. All bids are legally binding and enforceable in Ontario, Canada.

You will be notified by email if you have placed a bid, if you have been outbid, if you are the winner of a bid or if the auction of an item in your watch list is ending soon.

REMOVAL (if applicable)

All items are sold in place. Buyers are responsible to remove items in a good workmanlike manner. It’s recommended that you bring any and all tools, equipment and labour required to remove any items you purchased. The seller will not assist in any way with removal. Please plan ahead and come prepared. Any items not removed by the times shown will be deemed abandoned regardless of the price.

All winning bidders will receive an e-mail within 24 hours of the auction closing.

PICKUPS & REMOVALS (if applicable)

Dates and times for pickup will be posted on our website. Any item not picked up during the posted pickup times will be considered an abandoned item. Items are sold as is, where is, with all faults. If you abandon an item, it will be relisted for a new auction. Your bidding privilege might also be revoked.

We make all the necessary efforts to represent all items accurately in descriptions and photographs; however, all items are ultimately sold on an ‘as is, where is’ basis, with all faults. We strongly encourage all bidders to personally verify the condition of each item during the scheduled preview times. No responsibility is assumed by Rhino Bargain or the seller for any errors or omissions. Prices referenced are MSRP (Manufacturers Suggested Retail prices) and can be discounted significantly on the open market so do your own due diligence in researching values. Jewelry Appraisals are provided to us by the consignors and when provided are always insurance value appraisals which are usually much higher than retail values. Please also note that we are not professional jewelers and that we do our best to list jewelry items as they appear. Although an item may be stamped “10K, 14K, 18K or 925…”, it does not guarantee that this is such. We do not perform scratch tests as it damages the item. Therefore plating and/or filling and/or solidity are unknown. We do not have certified equipment to authenticate these items. As we do not accept returns of items that have been purchased, we ask that you bid at your own discretion, and any questions must be asked prior to bidding. All jewelry items may have minor flaws, scratches, or inclusions beyond our ability to identify precisely. You are bidding with this knowledge in mind.

As stated in our Refund Policy, no claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold on an ‘as is, where is’ basis, with all faults.

We will not be liable for damage or injury to individuals or their property.

We reserve the right to remove and/or add lots and/or items at any point during the auction.

The BUYER expressly agrees to indemnify and save Rhino Bargain, the Seller and their assigns harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of Rhino Bargain, or anyone acting in his/her behalf in connection with or arising out of auction. All bidders/buyers must be of legal age.

Very few items are sold with Reserve. If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a ‘reserve’, you will be required to pay a minimum amount in order to win the item.

In the unlikely event of a dispute, you agree to accept as true the information that we have in our records.

Items close at regular intervals. To prevent a bidder from ‘sniping’, all bids made in the last five minutes of the auction will force an item to stay open for an additional 2 minutes. This will continue until all bidding has ceased.

Bidding is similar to Ebay type auctions, we recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment.

If a description does not match a picture in a lot, the description takes precedence. All items are sold on an ‘as is, where is’ basis, with all faults. In the event an item was listed in error or an item can’t be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question and that all other items bid on remain binding.

You expressly understand and agree that Rhino Bargain and it’s Consignors shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Sebae has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service.

Rhino Bargain charges a flat consignment fee of 15% with a minimum commission of $5 per Lot. In some cases, lower consignment fees are available. When sending in Lots for consignment, please include your contact information as well as an itemized list of the Lots to ensure they are processed as quickly and accurately as possible.

Any unsold Lot will be placed into a future auction or returned to the consignor at the discretion of Rhino Bargain. All Lots will be live for the duration of the auction and will be sold to the highest bidder unless a reserve is not met. All reserve prices must be pre-approved by Rhino Bargain prior to the auction going live. We will not consider the request of reserves below $100. While we will do our best to accommodate reserves, reserves should be considered a request and not a guaranteed service. It is the responsibility of each consignor to ensure agreed upon reserve has been added to each auction as desired. A consignor can view the past, active and future consigned lots through the consignment dashboard. Rhino Bargain will not be held financially responsible for missing reserves.

It is the responsibility of the consignor to ensure any adjustment requests for auction Lots be submitted in a timely manner, preferably prior to the Lot going live. This includes but is not limited to requests regarding adjustments to reserves, titles, descriptions, photos, auction end date and/or auction type (such as sealed bid and regular). We will do our best to accommodate these requests within the guidelines of our policies and processes.

In consideration of our involved costs, we generally do not allow consigned items to be pulled from the auction. Rhino Bargain may accommodate a request to pull an auction Lot under certain circumstances. Any pulled Lot will be subject to a $20 fee.
